Terms and Conditions for Prince of Persia/ZOO promotion

1. Information on how to enter and prizes form part of these conditions of entry. The promotion is open to all residents of Australia aged 16 years and over only. If the winner is 15 years of age and under the prize will be awarded to the winner’s parent or legal guardian (as nominated on their entry form). 3. To enter, readers must answer either of the two (2) set questions in One Hundred and Sixty (160) characters or less and SMS their answers to 19922334. Also include the number of the question you are answering, either one (1) or two (2). Multiple entries accepted but each entry must be submitted separately and must be unique.

4. The best entry as determined by the judges for each question will be deemed the winner(s) and will win the major prize. 5. The Promoter will not be responsible for any incomplete or incorrect entrant contact details. Incomplete, illegible, incorrect and incomprehensible entries will be deemed invalid and will not be included in the judging.

6. All winners will be notified using contact details provided in their entry. Notification will be given by December 19th, 2008 at the latest. The Promoter accepts no responsibility for late, lost or misdirected mail. Prizes will be sent to winners by no later than January 9th, 2009.

7. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant state and territory regulations) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.

8. In the event that for any reason whatsoever the winner does not take all elements of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

9. Prizes cannot be exchanged or redeemed for cash and can only be transferred to the winner by the winners parent or legal guardian in the event that the winner is 16 years and under in age and the prize has been awarded to the winners parent/ legal guardian.

10. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant and/or (f) redemption of the prize;


All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. TERMS AND CONDITIONS FOR ZOO BEACH BABES 2009

1. The ‘Zoo Beach Babes 2009’ (“Competition”) is a game of skill. Chance plays no part in determining the winner. The Promoter is ACP Magazines Ltd ABN 18 053 273 546 54 of 54-58 Park Street, Sydney, NSW. The Promotion will be judged by a Panel of judges as appointed by the Promoter. Each entry will be individually judged based on a combination of originality, suitability for the promotion and literary and creative merit. Judging will take into consider popular voting by readers of Zoo Weekly as well as a judging criteria determined by the Promoter in its complete discretion.

2. The Competition begins on 10th Novemeber 2008 and stage one ends 11:59pm AEST on the 16th February 2009. Entry into this Competition shall be deemed as acceptance of these conditions of entry.

3. The Competition is open to all legal residents of Australia and New Zealand over the age of 18. Employees of the Promoter and their immediate families and agencies associated with this Competition are ineligible to enter. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Each entry must include a photo of one person who has given their consent to enter (“Participant”). One entry only per Participant, to be submitted online at www.beachbabes.zooweekly.com.au. To be eligible for the Prizes you must correctly fill in the online entry form and questionnaire, including your name, address, mobile phone number, date of birth. Complete with answers to all questions on the entry form and attach an image in the form of either a photo, video or a combination of both containing the image of the Participant only (“Entry”). Participants are invited to submit multiple separate images as part of the single entry. All material submitted is subject to these terms and conditions. Incomplete, indecipherable entries will not be included in the judging.

5. Non Participants ("Agents") may provide to the Promoter the email address of a potential Participant through use of the "Invite a friend" link on the entry website provided they have the consent of that person to be a Participant. Agents are ineligible to receive any Prizes under this competition.

6. During the first stage of the Competition Participants may have the images and parts of their entries as submitted with their Entry Form, published on the Zoo Weekly Website and/or in Zoo Weekly Magazine. The selection of images and Entries for publication (including but not limited to creative control) will be done at the absolute discretion of Promoter. It is a condition of entering this promotion that all entrants agree that by entering the promotion the give the Promoter a non-exclusive licence to publish their entries in all promotional, marketing and publicity purposes connected with this promotion and in all future promotional, marketing and publicity purposes it deems suitable.

7. After the first stage, Zoo Weekly Editorial staff will select the best entries from the competition for publication as “semi-finalists’ for this competition.

8. Semi- Finalists entry’s (or part thereof as determined by the Promoter) will appear on the Zoo Weekly website and in the Zoo Weekly magazine and readers and consumers of Zoo Weekly Magazine and the Zoo Weekly website ("Zoo Readers") will be called to vote via www.beachbabes.zooweekly.com.au to help select the finalists. At the end of Stage two. The judges will reconvene to determine who the finalists in this promotion are. Judging will take into consideration both the readers vote and the required judging criteria for this promotion.

9. The finalists will be required to participate in a series of photo shoots and/ or promotional activity with Zoo Weekly as required by the Promoter. It is a condition of entering this promotion that the finalist participates in this activity at the time/s stipulated by the Promoter. All photographs, interviews and other activity that is photographed, filmed or otherwise recorded or published remains the property of the Promoter.


10. During the final stage, Zoo readers will be called to vote for their favourite finalist. Zoo Readers will be asked to vote via www.beachbabes.zooweekly.com.au/. At the end of this stage votes will be collated and the finalists who have received the most online votes and been judged as the best, will be deemed the winner. ("Winner"). The winner will be declared online and in Zoo Weekly Magazine in the month of March 2009.

11. The winner will receive $10,000 and will have their photograph included on the cover of Zoo Weekly magazine and in various features appearing in the magazine in the future. The cash prize will be awarded in the form of a cheque made in favour of the winner. Inclusion of the winners photograph on the in feature appearing in the magazine and on the cover of Zoo Weekly (including but not limited to creative control and date of inclusion of the photographs and features) will be determined by the Promoter in its complete discretion.

12. During the term of the Competition participants may be required to participate in promotional activities including but not limited to public appearances, print, television and radio interviews, internet chat sessions and photo sessions at the absolute direction of the promoter to the extent permitted by law (“Promotional Activities”). Selection of individual Participants for inclusion in promotional activities is at the absolute discretion of the Promoter. Where requested by the Promoter participation in promotional activities forms part of the terms of entry into the competition and the Promoter may remove from the competition any participant that refuses to comply with a direction from the Promoter, their employees or agents. All participants agree that any entrant removed or excluded from the competition remains bound by these terms and conditions including but not limited to those concerning warranties, indemnities and the assigning of any copyright or other rights in material generated in association with this competition.

Editorial staff may remove at any time, and without any correspondence with, any Participant from the Competition for any reason in their absolute discretion, including but not limited to any statement, action or association of an Entrant that has the capacity to bring the Promoter or the Competition into disrepute.


14. Judges decision in relation to all aspects of this promotion will be final and binding on all entries and no correspondence will be entered into. Entries will not be returned. Participants acknowledge that Promoter will collect personal information of Participants and potential Participants. By entering you give a worldwide irrevocable licence to reproduce, publish, adapt, communicate and broadcast the Intellectual Property in any form and media and to sublicense those rights. You also consent to the Intellectual Property being edited, reused, stored and reproduced.

17. Participants and Agents agree to indemnify the Promoter against any actions arising from the publication of the Intellectual Property. No material, text or images submitted will be returned to participants.

18. Participants warrant that they have exclusive and complete rights to deal with the material provided to the Promoter, including the right to offer the material for publication. 9. General

Indemnity
You agree to indemnify and hold Zoo Weekly, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable solicitor's fees, made by any third party due to or arising out of your use of the ACP Magazines Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the ZOOWEEKLY website or through the ACP Magazines Services causes ZOOWEEKLY or ACP Magazines to be liable to another including but not limited to defamation, contempt and breach of privacy.

Severability:
If any part of this agreement is found to be invalid or of no force or effect under any applicable laws, executive orders or regulations of any government authority having jurisdiction, this agreement shall be construed as though such part had not been inserted herein and the remainder of this agreement shall retain its full force and effect.
Whole Agreement and Variation:

These terms and conditions represent the entire agreement between the Subject and ACP Magazines. Except as referred to in these terms and conditions, no other terms are to be implied which would have the effect of diminishing these terms and conditions unless required by law.

These terms and conditions may be varied at the sole discretion of ACP Magazines. By continuing to use the website you will be deemed to accept such variation.

Complaints and Queries

3.Promoter will not be liable for any loss or damage whatsoever suffered (including but not limited to direct or consequential loss) or personal injury suffered by entry, except for any liability which cannot be excluded by law.
4.The Participants and Agents agree to assign all rights and interests in any intellectual property, including words, text, images or sound provided by the Participant or Agent, or generated through or in connection with the Competition throughout its term, including but not limited to Qualifying Material and any material or image arising or created in connection with the Promotional Activities (“Intellectual Property”). Participants acknowledge that Promoter will collect personal information of Participants and potential Participants. By entering you give a worldwide irrevocable licence to reproduce publish adapt communicate and broadcast the Intellectual Property in any form and media and to sublicense those rights. 1. The Readers’ Submission Competition (“Competition”) is a game of skill only. The Promoter is ACP Magazines Australia Pty Ltd ACN 079 430 023 of Level 6, 187 Thomas Street, Haymarket, NSW . Editorial staff of Zoo Weekly are the Judges.
